Here is what s 37 of the Mining Act 2010 says about the creation of retention licences:

 

Firstly, MNS doesn't have a Retention Licence

 

Secondly, if the resident legal guru had looked at the amendments to the Mining Act 2010 - in 2017 - he would be aware that Retention Licences were "abolished" under the new Act - hence anyone who had a retention licence is impacted - IDA was one, PEK was another . This is an extract from PEK - note they intend to apply for a Mining Licence

 

Abolition of Retention Licences

The new Act removes all provisions which provided for retention licences.

A Retention Licence could be applied for under the previous legislation if the holder of a

prospecting licence is unable to develop the project at present due to low commodity low prices.

Not sure how the cessation of Retention Licenses impacts MNS, or why "horrifically delayed progress on a special mining licence permit" does not also warrant a warning to another company with "horrifically delayed progress on a regular mining licence permit"..
